Franchise Procedures and Policies

What is a Franchisor?

A franchisor sells the right to open stores and sell products or services using its brand, expertise, and intellectual property. It is the original or existing business that sells the right to use its name and idea. The small business owner who purchases these rights is called a franchisee and the branch business, itself, is called a franchise.

 Being a Franchisee

Running a franchise can be a great opportunity for entrepreneurs with limited business experience because:

  • Startup costs are often lower than building a business from scratch.

  • The franchise provides immediate brand recognition, a pre-established supply chain, and professional marketing support.

  • Franchisees can follow proven business practices set by the franchisor rather than developing them independently.

  • Franchisors have a vested interest in franchisee success, often providing active guidance and support.

The Franchisee-Franchisor Relationship for a Virtual Brand

In a virtual brand model, the franchisee-franchisor relationship is centered on guidance and support, with the franchisor advising on digital operations, virtual team management, online marketing, and supply chain logistics.

Each franchisee is encouraged to develop and implement their marketing approach (See...Marketing Compliance Checklist) based on their unique strengths and preferred strategies, giving them flexibility to leverage their expertise effectively. In return for access to the brand’s intellectual property, digital infrastructure, and expert resources, the franchisee pays an initial franchise fee along with ongoing royalty or licensing fees.

Steps to Becoming a Franchisee

Becoming a franchisee can be an exciting and rewarding venture, especially with the advantage of an established brand and business model. Here’s a guide to help you get started:

  • Research Your Options: Decide what type of franchise you’re interested in. Narrow down to a few brands that spark your interest and have availability in your region.

  • Evaluate Financial Requirements: Each franchise has its own investment level. Look into the costs involved for each option and ensure it aligns with your budget to avoid disappointment.

  • Connect with Current Franchisees: Speaking to existing franchisees offers insight into the advantages and challenges they’ve faced, as well as an overview of franchise expectations, costs, and the overall system.

  • Create a Business Plan: Develop a business plan as your proposal to the franchisor, outlining your goals and financial projections. This plan also helps you and the franchisor assess potential revenue and cash flow, especially in the first year.

  • Review the Franchise Agreement: Carefully go over your rights, responsibilities, and role in the business before signing. Consider having a lawyer review the contract for clarity.

  • Establish Your Business Entity: Set up your business as an LLC or corporation to solidify your legal and operational structure.

  • Choose Your Location: Most franchisors will provide guidelines on ideal locations for their brand, helping you find a spot that aligns with their vision.

  • Hire Staff, Market Your Business, and Launch: Recruit a team, start your marketing efforts, and begin serving customers as an official franchisee.
